evec is licensed to You (End User) by evec Ltd, registered in England and Wales, with its registered office at Unit 8, Centenary Park, Coronet Way, Salford, M50 1RE, England (Licensor), for use only under the terms of this End User Licence Agreement.Our VAT number is GB 404 4269 19.By downloading the Licensed Application from Apple’s software distribution platform (“App Store”) or Google’s software distribution platform (“Play Store”), and any updates thereto, You indicate that You agree to be bound by the terms and conditions of this End User Licence Agreement.Apple and Google are not parties to this End User Licence Agreement and are not responsible for the Licensed Application or its content. evec Ltd, and not Apple or Google, is solely responsible for the Licensed Application.This End User Licence Agreement does not override Apple Media Services Terms and Conditions or Google Play Terms of Service. evec Ltd acknowledges that it has reviewed those terms and that this End User Licence Agreement does not conflict with them.The Licensed Application is intended for use on devices operating Apple iOS, Apple macOS, or Google Android.

1. The Application

   evec is a software application designed to control and manage an electric vehicle charger using a mobile device.

2. Scope of Licence

   This licence governs use of the Licensed Application and any updates provided by the Licensor, unless a separate licence is provided.

You may not reverse engineer, decompile, disassemble, modify, translate, adapt, or create derivative works from the Licensed Application without prior written consent from evec Ltd.You may not copy or distribute the Licensed Application except as permitted under this licence and applicable App Store or Play Store usage rules. You must remove the Licensed Application from Your device before selling or transferring it.Any breach of this licence may result in termination and legal action.evec Ltd reserves the right to modify this End User Licence Agreement from time to time.

1. Technical Requirements

   The Licensed Application requires compatible hardware, firmware, and operating systems. evec Ltd may update technical requirements at any time.

You are responsible for ensuring that Your device meets the minimum technical requirements.

1. Maintenance and Support

   evec Ltd is responsible for providing maintenance and support for the Licensed Application. Apple and Google have no obligation to provide maintenance or support services.

2. Use of Data

   evec Ltd may collect and process personal data and technical data necessary to operate and maintain the Licensed Application, including device information, usage data, and charger operational data.

Personal data is processed in accordance with the evec Privacy Policy available at https://evec.co.uk/privacy-policy/.Data may be used to provide application functionality, customer support, software updates, security, and service improvement.Participation in optional services, including any grid services or flexibility programmes, is governed by separate terms and conditions and requires explicit opt-in. Such services are not enabled by default through acceptance of this End User Licence Agreement.

1. User Generated Content

   Where the Licensed Application allows submission of content or feedback, You confirm that You have the necessary rights to provide such content and that it does not violate applicable laws or third-party rights.

2. Contribution Licence

   You grant evec Ltd a non exclusive right to use feedback provided for the purpose of improving the Licensed Application. You retain ownership of Your content.

3. Liability

   evec Ltd is not liable for damages caused by unauthorised modification or misuse of the Licensed Application, except where liability cannot be excluded under applicable law.

4. Warranty

   The Licensed Application is provided as described but without guarantees that it will be error free or uninterrupted, except as required by law.

5. Product Claims

   evec Ltd is responsible for handling product related claims concerning the Licensed Application.

6. Legal Compliance

   You confirm that You are not subject to trade sanctions or restrictions under applicable law.

8. Termination

   This licence remains in effect until terminated. Upon termination, You must stop using the Licensed Application and delete all copies.

   Apple and Google are third-party beneficiaries of this End User Licence Agreement and may enforce it as applicable.

10. Intellectual Property

    evec Ltd retains all intellectual property rights in the Licensed Application.

11. Applicable Law

    This End User Licence Agreement is governed by the laws of England and Wales.
